Jim Pearce delivered a paper entitled “Establishing the Identity of the Employer in Labour Hire and Intra-Group Employment Situations” in Brisbane on 8 June 2018. The paper dealt with the problems which occasionally arise in employment situations concerning the circumstances, where it is unclear which of several possible corporate entities is the employer of a particular employee. Jim notes that this situation can arise in at least four circumstances, namely where independent contractors are utilised; where labour hire arrangements are utilised; in intra-group employment situations; and where a combination of the above apply. The paper collected together the relevant case law in relation to the later three circumstances and described the approaches taken by various courts.
